Terms of Service

By accessing or using any services provided by AIS (operated by STUDENT Inc., hereinafter "the Company," "we," "us," or "our"), including but not limited to Giftframe, Skindraft, Hushloom, and Bedtale (collectively, "the Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Services.

These Terms constitute a legally binding agreement between you and STUDENT Inc. You must be at least 16 years of age to use the Services. If you are under 18, you must have parental or guardian consent.

AIS provides AI-powered creative services through the following platforms:

• Giftframe — AI-generated art from personal photos, designed as personalized gifts.
• Skindraft — AI-assisted custom tattoo design generation based on user descriptions and preferences.
• Hushloom — AI-crafted personalized ambient soundscapes for relaxation, focus, and sleep.
• Bedtale — AI-generated personalized children's bedtime stories featuring user-specified characters and themes.

All Services utilize artificial intelligence and machine learning technologies. Results may vary and are generated algorithmically. We do not guarantee specific outcomes or exact reproduction of any requested content.

To access certain features of the Services, you may be required to create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Promptly notifying us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable notice where practicable.

Certain Services or features may require payment. By purchasing a paid service, you agree to:

• Pay all fees as described at the time of purchase
• Provide valid payment information through our payment processor (Stripe)
• Accept that prices are in the currency displayed and may include applicable taxes

Subscription services will automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds are handled in accordance with our refund policy and applicable law.

Free tier services are provided at our discretion and may be modified or discontinued with reasonable notice.

Your Content: You retain ownership of any content you upload to or create through the Services (photos, descriptions, preferences, etc.). By uploading content, you grant us a limited, non-exclusive license to process and use that content solely for the purpose of providing the Services.

AI-Generated Content: Content generated by our AI services is provided to you under a license for personal and commercial use, subject to the specific terms of each service. You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions.

Our IP: The Services, including all software, algorithms, models, designs, text, graphics, and other materials, are owned by or licensed to STUDENT Inc. and are protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features.

You agree not to use the Services to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create content depicting minors in any inappropriate or exploitative manner
• Generate content that infringes on any third party's intellectual property rights
• Attempt to reverse engineer, decompile, or extract our AI models
• Use automated systems (bots, scrapers) to access the Services without our prior written consent
• Circumvent any content safety filters or access restrictions
• Resell or redistribute the Services or access thereto without authorization
• Upload content containing malware, viruses, or other harmful code

Violation of these prohibited uses may result in immediate account termination and may be reported to appropriate authorities.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Services will meet your specific requirements; (b) the Services will be uninterrupted, timely, secure, or error-free; (c) the AI-generated results will be accurate, reliable, or satisfactory; or (d) any defects in the Services will be corrected.

AI-generated content may occasionally produce unexpected, inaccurate, or inappropriate results despite our safety measures. You use the Services at your own discretion and risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STUDENT INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (US$100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Notwithstanding the foregoing, nothing in this clause shall prevent either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on our website and, where practicable, by email notification to registered users.

Changes become effective upon posting unless otherwise specified. Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms.

If you do not agree with any changes, you should discontinue use of the Services and close your account.
